Area Development Overview

Abstract: This form outlines the terms and conditions for basic area development guidelines regarding construction of Totally Tommy buildings.

Area Development Agreement

o    The Opportunity:

• Exists to develop and area as the exclusive developer of Totally Tommy car wash buildings.
• The opportunity applies only to the Totally Tommy building and not to the barrel vault building design.
• Nor does the opportunity affect Tommy equipment package sales.

o    Exclusive partnerships:

• We believe we would like only one person building Totally Tommy buildings in an area to create a development and also not create confusion to the customer having alike buildings.
• We require exclusivity in return that you work strictly with Tommy’s in the development of car washes and not any other equipment manufacturer in other developments you may do.

o    Selection of Area:

• Simply select an area you would like to claim exclusive. Do so by submitting to the Tommy office a map with a circle of your proposed exclusive development.
• Tommy’s will return to you a contract regarding the number of stores you will be required to build in that area. You will be allowed a given timeframe to have all stores up and operating based on how many stores are required to build. (roughly 1-2 stores per year would be acceptable pace)

o    Development Process:

• The requirements of store construction is based on several factors
  • Market Potential
  • Competition
  • Population
  • Number of Vehicles on the road
  • General Opportunity in region
• Upon completion of contract the developer will hold and sustain an exclusive protected area for Totally Tommy building developments.

o    Failure to Complete:

• In the case a developer fails to meet the required number of stores in the required timeframe the developer will simply break the agreement and the territory will be opened up to other developers.
