Also valuable for registers of deeds, clerks of superior court, and practicing attorneys.The new edition contains updated text and forms since publication of the ninth edition, 2004, including Session Laws 2005-391 (Senate Bill 671) and 2006-59 (House Bill 1432), which have substantially changed the notary laws in this state. The tenth edition reflects the laws that go into effect October 1, 2006. The new Chapter 10B, Notary Public Act, makes substantial changes to the prior notary law and introduces a new Electronic Notary Act. The changes include, among other things, clarification about what is required for notary seals and the appearance of the notary’s name on notary certificates; clarification about disqualifying circumstances; specific direction about what constitutes personal appearance of principals and subscribing witnesses and what a notary must do to verify their identity; how a signature can be made by mark; new forms of acknowledgment certificates and direction about what must be included in certificates completed by notaries; changes in the notary application, education, testing, and commissioning requirements; and changes in the law regarding criminal offenses and sanctions for violating the notary laws.
